Denton, TX / Fence permit planning

Ordinary residential fence applications in incorporated Denton, not Denton County generally, Lantana or another municipality. The adopted 2021 IRC amendments effective June 1, 2022 delete the model fence exemption; the city-linked Development Code printed October 20, 2026 includes the September 15, 2026 comprehensive amendment, section 7.7.8 and relevant jurisdiction, conflict and floodplain provisions. No universal rear-height cap is supplied because the residential webpage's eight-foot summary and Table 7.H's no-maximum interior-side/rear row differ. Special zoning/overlay, historic, floodplain, easement, pool, retaining and powered-gate questions need their applicable determinations. This guide does not approve a parcel or provide engineering.

In the City of Denton, new and replacement residential fences normally require a permit. A narrow city FAQ exception covers certain matching minor repairs and damaged-picket replacement; it is not a blanket like-for-like replacement exemption. Prepare a scaled site plan, use the residential fence application, obtain issued approval and complete the required final inspection. Quick reference

QuestionSource-checked answer
New and replacement permitsDenton's residential fence process requires an application for new and replacement work. Its adopted 2021 IRC amendments delete Building item 2, the model fence exemption; a generic seven-foot no-permit rule is not Denton's answer. Denton residential fence permit page; Denton fence replacement and permitting FAQ; Denton adopted 2021 IRC amendments; ICC 2021 IRC exemption text
Narrow repair exceptionsThe city FAQ exempts damaged-picket replacement and limited repairs using the same material in the same location. For the limited-repair exception, neither the one-panel nor the two-post limit may be exceeded. Do not extend this to full replacement, relocation or changed dimensions/materials. Denton fence replacement and permitting FAQ
Plan and applicationProvide a scaled site plan showing structures, property lines, proposed fence and known easements. The form asks for scope, yard/corner information, height, length, material and owner/applicant/contractor contacts. Retaining work has separate supporting requirements. Denton fence submittal requirements; Denton fence permit application
Easement replacement is not automaticThe DDC prohibits fences in easements and right-of-way. The current submittal sheet separately describes previously permitted fences replaced in their original easement location with photo documentation and owner liability. Submit that evidence for city review; do not assume any existing fence qualifies. Denton current adopted Development Code; Denton fence submittal requirements
Current residential feeThe adopted schedule effective October 1, 2026 lists Residential Fence Permit at $50. Commercial and retaining fees are separate categories. The schedule directs applicants to Building Safety for final totals; registration, reinspection or other applicable charges may change the invoice. Denton adopted October 2026 fee schedule
Layout versus final inspectionThe current fence submittal sheet marks layout inspection optional and lists final inspection for ordinary and replacement fences. Use the city's eTRAKiT entry and follow the issued record's inspection requirements; optional layout does not mean optional final. Use the residential fence application

Denton maintains a residential Fences page with a fence application, submittal sheet, inspection information and current fee link. Use the residential page for an ordinary home fence. The city's form separately asks whether the project is commercial or residential and whether it is new, replacement, repair, retaining or pool fencing. Denton residential fence permit page; Denton fence permit application.

The residential code adoption provides another important check. Denton's adopted 2021 IRC amendments, effective June 1, 2022, delete Building item 2 of R105.2. In the actual 2021 model text that item is the short-fence exemption. Do not quote the unamended model's seven-foot exemption as Denton's local rule. Denton adopted 2021 IRC amendments; ICC 2021 IRC exemption text; Denton current residential permit process.

What the repair FAQ actually exempts

The city's replacement FAQ says a permit is generally required. Its limited repair exception requires the same material and same location; neither the one-panel nor the two-post limit may be exceeded. It separately says replacement of damaged pickets does not require a permit. Describe each retained and replaced component so staff can evaluate the actual scope. Denton fence replacement and permitting FAQ.

Do not use that language to justify a complete replacement, changed alignment, new height or different material. Identify pool-barrier work separately and preserve required safety protection while it is reviewed; the ordinary repair answer is not a pool-barrier design or a waiver of other applicable rules.

Confirm the controlling height rule

The city-linked Development Code has a print date of October 20, 2026 and an amendment list through the September 15, 2026 comprehensive amendment. Use 7.7.8, including Table 7.H, rather than older 2020 or 2021 PDFs. The code became effective October 1, 2019 and has been amended since. Denton official development-code and criteria entry; Denton current adopted Development Code.

For the specified ordinary residential types, Table 7.H distinguishes front/street-facing side yards from interior side/rear yards. The street-facing row depends on whether the fence extends beyond the principal structure's front building line; it generally uses four feet beyond that line. The text also provides a Director/designee alternative-height process with safety and neighborhood conditions, not automatic approval. Materials and opacity conditions remain part of the review. Denton current adopted Development Code.

There is a source difference worth preserving. The residential webpage states an eight-foot maximum, while the current DDC interior-side/rear table row says no maximum. A zoning table without a stated maximum is not unlimited construction permission, and another applicable ordinance or building requirement may still control. We therefore publish no universal rear-height number and advise applicants to obtain the controlling height and design approval for the actual location. The DDC's conflict provision calls for the stricter applicable provision as determined through the city's interpretation procedure. Denton residential fence permit page; Denton current adopted Development Code.

This limitation does not make the new-fence permit, documents or fee unknown. It prevents a simplified height summary from being presented as permission to build an unreviewed taller fence.

Easements, drainage and visibility need distinct review

DDC 7.7.8 prohibits fencing in right-of-way, easements, designated fire lanes and required parking spaces, and preserves safe passage and sight lines under the transportation criteria. Show these features on the plan. An open material is not automatic visibility clearance, and no universal safe triangle is prescribed here. Denton current adopted Development Code.

The current fence submittal sheet separately describes replacing a previously permitted fence in its original easement location, with photographic documentation and owner responsibility for damage if access is needed. That operational guidance is not a blanket enacted exception for every old fence. Submit the photos and prior-permit/location evidence for staff to confirm the applicable approval basis; an unpermitted fence does not become eligible merely by existing. Denton fence submittal requirements; Denton current adopted Development Code.

The current DDC also prohibits new fences within the floodplain unless the Floodplain Administrator approves a site-specific exception with adequate mitigation. Do not design a breakaway section from this article or assume a drainage easement and floodplain are interchangeable. Pool, retaining-wall, historic/overlay and powered-gate work need their applicable reviews. Denton current adopted Development Code; Denton fence submittal requirements.

Prepare a fence plan and the actual application

The current submittal sheet asks for a scaled site plan showing all structures, property lines, proposed fence location and known easements. The form adds yard positions, corner-lot status, height, total linear feet, material, land use, scope and owner/applicant/contractor information. Retaining walls have separate engineered/supporting information; do not demand that package for a fence with no retaining function. Denton fence submittal requirements; Denton fence permit application.

  1. Confirm city jurisdiction and the correct address/parcel, zoning and any special site conditions.
  2. Distinguish new work, same-location replacement, changed material or dimensions, relocation and limited repair.
  3. Mark each fence and gate run on the scaled plan with the relevant height, material and boundary/easement relationships.
  4. Provide any prior-permit photos and original-location evidence needed for the stated easement replacement review.
  5. Use the official city permit entry, which currently redirects to Denton's eTRAKiT service, and follow the current account/application instructions.
  6. Resolve review comments, confirm applicable fees and obtain issued approval before permit-required construction.

The city's public portal says contractors must be registered. The address must be linked to the correct parcel; ask staff for help when it does not resolve rather than treat a nearby address as proof of jurisdiction. Denton official permit portal entry; Denton fence replacement and permitting FAQ.

October 2026 fees and the required final

The adopted Building and Health Permit Fee Schedule is effective October 1, 2026, under Ordinance 26-1576. It lists Residential Fence Permit: $50, separately from commercial linear-foot and retaining-wall categories. The schedule instructs applicants to contact Building Safety for final totals. Registration, reinspection or additional scope can create separate charges; do not automatically add an unrelated house plan-review row or assume an all-in amount. Denton adopted October 2026 fee schedule.

The submittal sheet marks Layout Inspection optional and separately lists Final Inspection for ordinary and replacement fences. Optional layout is not optional final. Contractors use the city's inspection portal; owners should coordinate through the current city instructions and follow the issued record. Retain the final inspection report rather than assume a house-style certificate of occupancy is required for a fence. Arrange the applicable Texas utility-location process before digging. No fixed approval time is promised. Denton fence submittal requirements; Denton current residential permit process; Denton official permit portal entry.
